Terms of Service

These terms and conditions form an integral part of your usage contract, regardless of reservation made online or in person.

Definitions: The “Hirer” is the person renting or using the product as defined as the person who receives the product.

The hirer must be at least 18 years old. The Hirer accepts full legal liability for all the equipment listed on the hire contract(s) irrespective of whether the equipment is for the Hirer’s personal use, or that of another member of his/her party.

“Equipment” includes roof racks, roof boxes, and any other item(s) hired by the Hirer from us. The hire period is the date from which the equipment is received by the hirer from us or our agents, until the date that the hirer is due to return the equipment or the equipment is returned, whichever is later.

Conditions of Hire

1. When the hirer receives their hire contract, currently a confirmation email, it is the hirers responsibility to check the details of the contract, especially the dates and time of hire as no refunds are issued, including address, delivery information if being delivered, details of your vehicle and the equipment you have hired.
2. The Hirer accepts full personal liability for the equipment from the time he/she receives it from us, until it is returned to us at the end of the hire period in the condition it was initially received.
2.1 The hirer shall not remove any labels from and interfere with the equipment, their working mechanisms or any part of them and shall take reasonable care of the equipment while on hire. 
2.2 The hirer will take adequate and proper measures to protect the equipment from theft, damage and or risks such as adverse weather.
2.3 The hirer understands the equipment becomes part of a car and has an automotive-type finish that is not intended to be slid on the ground, stored on its side, or improperly stored or positioned, including when retuning equipment; don’t slide the equipment on the ground because it gets scraped up and is not repairable. It is not meant to be rubbed on concrete, walls, or otherwise.
3. Replacement and Loss of Use Costs: We reserve the right to charge the hirer the full cost of such equipment and loss of use fees in the event that it becomes damaged, lost, and/or stolen during the period of hire, kept beyond the time and date of hire, or until it has been returned to us. Rental payment does not apply towards replacement cost or loss of use fees. Replacement costs and loss of use fees are to be paid in cash or via credit card. Replacement equipment is not accepted. Payment is due immediately or at the date and time specified in the hire period. Fees of 10% will be added each month until payment is made in full.
Replacement costs are as follows:
– XXL Roof Box $849.95 (unpainted) or $1,049.95 (painted) plus tax (8.3%) and shipping ($175) if necessary or replacement cost from Thule, whichever is greater.
– XL Roof Box $799.95 (unpainted) or $949.95 (painted) plus tax (8.3%) and shipping ($175) if necessary or replacement cost from Thule, whichever is greater.
– L Roof Box $749.95 (unpainted) or $899.95 (painted) plus tax (8.3%) and shipping ($175) if necessary or replacement cost from Thule, whichever is greater.
-Lost keys chargeable at $25 per key. Please inform Roof Box Guy as soon as possible if this occurs so key can be ordered.
-Broken key in lock $55. Please inform Roof Box Guy as soon as possible if this occurs so replacement parts can be ordered. 
-Loss of Use Fees are reasonable rental fees that are unable to be collected while equipment is unable to be hired out. Rental equipment is frequently scheduled to go out within 60 minutes of return of equipment, thus loss of use fees may be collected from the time of scheduled return. 

4. Delivery of Equipment: The Hirer or his/her agent will be expected to inspect equipment on collection. By departing with equipment, the Hirer or his/her agent acknowledges that they have inspected the equipment & confirms that the equipment is in satisfactory working order and condition.
5. Returning Equipment Late: If the equipment is returned after the Return Date printed on the contract, we reserve the right to charge the Hirer at the daily rate of hire for each day the equipment is late ($20/day) up to the replacement cost of the equipment, as specified in section “3” above, together with any legal fees or associated recovery costs. In the event that non-return of equipment impacts another rental period, the equipment will be replaced at the expense of the Hirer. Hirer shall be given opportunity to own the equipment they have in their possession. In the event Hirer wishes to store equipment while using hired equipment, if space allows, the charge is $35 per week or partial week and will be considered abandoned property, free and clear of all liens and encumbrances, on the originally scheduled date of return.
6. Deposits: We reserve the right to demand a deposit from any hirer at any time up to and including the Hirer collecting the equipment from us. The amount of such deposit is to be at our absolute discretion. We reserve the right to refuse to hire equipment to any client with whom we do not wish to enter into a contractual relationship. We reserve the right to cancel a contract at any time and without notice, whereupon we will refund to the hirer any monies paid. Following such a refund, no further liability will exist between the hirer and us.
7. Roof Rack Fitting: It is the Hirer’s responsibility to ensure that these items are correctly fitted to the appropriate vehicle and remain properly fitted during the period of hire. Where we assist the Hirer with fitting such equipment to a vehicle, this will be entirely at the Hirer’s risk and we accept no liability for any damage caused either to the vehicle or third parties as a result of fitting such equipment.
8. Save as provided in these conditions and to the extent that the exclusion or restriction of liability may be prohibited by statute, we will not be liable for any loss, damage or injury caused, directly or indirectly, by the equipment or its use. Your statutory rights are not affected.
9. Any usage or interaction with our equipment will indicate agreement to these terms and conditions, regardless of having read these terms and conditions, having been to the website, or having the terms and conditions demonstrated in any way, shape, or form, and applies regardless of form of payment (typically credit card, but could be others) or form of reservation (typically via the website, but could be others). 
10. A good faith effort will be made to provide the roof box size as indicated in the original reservation, however we reserve the right to substitute a different size at any time. This is done in the event a roof box is returned to us damaged, is not returned when originally stated, or is unusable in any way. We never double-book boxes and any substitution is due to an event out of our control. Thank you for understanding. 

THE ROOF BOX MAY ELIMINATE THE USE OF PARKING GARAGES due to height restrictions.
